Liability Waiver & Assumption of Risk

1. Voluntary Participation

Your participation in Malaika Commons events and activities is entirely voluntary. By choosing to participate, you acknowledge that you are doing so of your own free will and accept full responsibility for your participation.

2. Assumption of Risk

You understand and acknowledge that participation in events involves inherent risks, including but not limited to:

In-Person Event Risks

• Exposure to communicable diseases, including COVID-19, influenza, and other illnesses
• Personal injury from slips, trips, falls, or other accidents
• Injury from interactions with other attendees
• Property damage, loss, or theft
• Food allergies or reactions
• Venue-related hazards
• Emergency situations

Travel Risks

• Transportation accidents or delays
• Travel-related illness or injury
• Flight cancellations or disruptions
• Lost or delayed luggage
• Any other travel-related incidents

Virtual Event Risks

• Technical difficulties or platform failures
• Cybersecurity incidents
• Privacy breaches
• Recording without consent by other participants

3. Health Acknowledgment

By attending in-person events, you represent and warrant that:

• You are in good health and capable of participating
• You are not experiencing symptoms of communicable illness
• You will follow any health and safety guidelines provided
• You will not attend if you are feeling unwell
• You understand that attending events with large groups carries inherent health risks

4. Release of Claims

To the fullest extent permitted by law, you hereby release, waive, discharge, and covenant not to sue Malaika Commons, its officers, directors, employees, agents, volunteers, sponsors, partners, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or to any property belonging to you, arising from your participation in any Malaika Commons event or activity.

This release includes, but is not limited to, claims arising from:

• Negligence of the Released Parties
• Conditions of any premises or facilities
• Actions of other attendees or third parties
• Any defect in equipment or materials
• Any other cause

5. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising from:

• Your participation in any event
• Your violation of any term in this waiver or any other Malaika Commons policy
• Any claim by a third party arising from your actions or omissions
• Any injury or damage you cause to others or their property

6. Medical Treatment Authorization

In the event of an emergency, you authorize Malaika Commons and its representatives to obtain emergency medical treatment on your behalf if you are unable to do so yourself. You agree to bear all costs associated with such medical treatment.

7. Personal Property

Malaika Commons is not responsible for any loss, theft, or damage to your personal property at any event or in any venue. You are solely responsible for safeguarding your belongings.

8. No Insurance Provided

Malaika Commons does not provide insurance coverage for participants. You are responsible for obtaining your own health, travel, and personal property insurance as you deem necessary.

9. Severability

If any provision of this waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect.

10. Governing Law

This Liability Waiver shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflicts of law principles.
